If your working with a gay person and he starts making flurtation comments after you told him that your not cool with it, could you sue for sexual harrasment? Its the same thing in my opinion when guys do it to women, right?

If anyone, regardless of gender or sexual orientation, does that you can charge them with sexual harrassment. First you need to get management involved. They should sit down with your coworker and explain that what he is doing is not allowed and warn him that if it continues he may be fired. Then if it happens again the management needs to take swift action. If they do nothing take them to court along with the coworker.

Yes you can. When my husband and I worked for a large company years ago, he wrote up an employee for being habitually late. The guy was gay and filed charges against my husband for sexual harassment. The charges were later dropped but it was a hassle. You can sue a gay person and a gay person can sue a straight person for sexual harassment.

Well you prolly can not sue them you can but i think thats going to far for the first step!!!

First you should go to your employer and Report and file a sexual harrasment complain. and like them handle it but befor that you should go to the guy and tell him if he does not stop you are going not to going to take it any more. sexual harrasment is some thing Gay/ straight/ Lesbian should not have to deal with at work!!!

In America, you can sue anyone for anything. Personally, if (on the unlikely chance) a gay co-worker hit on me, I would quietly tell him that I wasn't comfortable with it and to please quit. If it was continued after that, I'd take it to my boss and up the ladder before I considered a law suit. I'll put off giving a lawyer any money as long as possible.

yes anyone can be sued for sexual harrasment, but you actually want to sue the company you work for, it is the company who is responsbile to be sure no sexual harrassment occurs.

You file a complaint with them, and they warn the person doing it.

I'm not sure but I think you can. I worked with a woman who was gay and would "accidentally" brush up against my boobs, touch my butt, and lean up against me. I told my supervisor, who said others had complained, yet nothing was done. I'm not homophobic, I just think the rules should apply to everyone, gay or not. Look into it. I think you have the right not to be harassed by anyone.

If a guy makes a flirtacious comment to me, I may not like it, but I certainly don't sue over comments. How about tell him if he does it again, after you already told him to stop that you will report it to management. He'll stop.
