Your question is complex, but basically you need to gather more information as to waht is his status.
Is he undocumented or oversatyed?
I mean, if he cross the border without permission (visa or pass) you can't do anything for him, even if he has never been in trouble. The fact that he crossed the border ilegally diminishes all his possibilities to obtain a legal status in the USA un less the so called i(245) comes into effect, which is not happening according to my understading. The only choice would be to hire a lawyer and IF he wants to take the risk, send the petition to INS or DHS (don't remember the name) and wait until he's called for an interview IN HIS COUNTRY. After the inteview he will need a sponsor (you or employer) to invite him to the USA. But the USA can penalize him up to 10 years of staying in his country before he can come back (even to visit) to the US. This is a big risk.
By othet hand if he came with any type of visa and overstayed without any valid permission (or extension), you can go and hire a lawyer who can start the paperwork for you and send it to the DHS. It woud take him log before he can have his legal status (probably two-to-five years ) or work permit and more to get his residency.
The laws of the USA do not make distinction wheter he is a "good" person who pays taxes or doesn't have a ticket, is he is not legal in this country, that's what counts.

YOU CAN'T!!!!! Sorry but he is a criminal for breaking our laws. I know all the PC stuff about how they come to America for a "better life." Tough! Your husband, and every one like him, do not belong here.
He can't apply to become legal while committing an ILLEGAL act. It doesn't matter if you have been married 50 years and had 10 kids! He must go back to Mexico and start the process right.
Don't give me that crap about he's never been in trouble! He's in troub;e now because he is a criminal by being here ILLEGALLY.
What part of ILLEGAL don't you understand? What gives you husband the right to break our laws?

Why have you waited so long to start asking questions? You need an immigration lawyer, you have to prove that he is not in the system, that he has not been back to visit, or gotten caught and sent back, people seem to be under the impression that just because your married or have kids illegals are intitled to obtain statis it is not true.

Of course the irony is that it is precisely BECAUSE of people like your friend that the waiting list for a hearing is about 8 years and counting!
