I recently filed my taxes but it was denied by IRS, because my dad used my s.s on his tax to claim school expenses.
Is there anyhting I can do?

You need to remove the exemption from your return, if you claimed yourself on the return it will cause the system to automatically reject the return, try to input without the 3,300.00 exemption (can someone else claim you as a dependant) that should correct the problem. If not you will need to make the above change and mail the return in.

If you can be claimed as a dependent on your father's tax return, refile your return and check the box that says you can be claimed as a dependent by another taxpayer.

You didn't provide enough information to determine if your father can claim you as a dependent. Generally if you are a full time student and under 24 he can claim you if he provided more than half of your support.

If your father cannot claim you as a dependent, you'll have to file a paper return and mail it in. The IRS will flag both your and your father's tax returns and request proof of your exemption claims. They'll then decide if your father can or cannot claim you as a dependent. If he cannot, he'll get a bill for the additional tax due.

All of the other gentlemen are correct. If your father knew what he was doing, and he is able to claim you as a dependent, then you simply need to re-submit your return with the item selected that someone else can claim you as a dependent.

It depends whether your dad meets the rules to claim you as a dependent, or not. If he does, then you need to refile, showing on your return that you can be claimed as a dependent. If he isn't allowed to claim you, then he needs to file an amended return taking you off of his original return, and you'd need to mail in your return claiming yourself.

Since you mention school expenses, I'm assuming that you are a full-time student. If you are under 24, lived with your dad for over half the year (temporary absences while you're away at school count as still living with him if you live there when you're not in school), and didn't provide over half of your own support for the year, then he can claim you. Or if you are 24 or older, he paid over half your support for the year, and your gross income for the year was under $3300, then he can claim you. If you don't meet either of those, then he can't.

you can send your 1040 in with an explanation that you want to and are able to file for yourself (income over $850, paid all your own living expenses) and what the IRS will do is pull your dads return, review his and yours and decide who gets to claim you. This will take around 2 months.

Nope. Not unless you can convince your dad to file an amended and not claim you as a dependent.

Maybe you could talk with your dad and ask him to give you the refund that you would have gotten had you filed on your own. He was able to take advantage of deducting your school expenses...he should be willing to do this for you.

Yes.

You need to amend your return and indicate on page 2 of Form 1040 that you are being claimed as a dependent on someone else's return.

Seek out a professional to do your amended return; Amended returns require certain procedures in order for the return to be "compliant" with IRS procedures. Most taxpayers are not saavy as to what to do - so have a professional do it for you.
