You can not use the fictious SS# on the return. You need to contact the employer to get a corrected W2. You would leave the space for the Tax payer ID blank on the tax return, The IRS will issue the ITIN after processing your W7 application.

You could have a real problem here. Don't under any circumstances put the bad SS# on your return - use the ITIN. But there's no way for you to file that W-2 that shows the bad SS#.
If the number belongs to someone else, then when the IRS matches up W-2's and returns, the person that SS# really belongs to will be contacted by the IRS to ask why they didn't file it on their return - when they say well, because I didn't work there, then the #&*@ will unfortunately hit the fan, the employer contacted, and both the employer and the person who used the bad number will be in trouble. I'm not trying to lecture you - this is just where this is going.
The only possibly way out, without getting into even more trouble, is to see if the employer will issue a replacement W-2, with the ITIN. There's a lot of backtracking that would be required here, so this might or might not be possible.

Hundreds of times each day people with your issue file returns with the ITIN and report the income on the W-2 as if it had the ITIN in place of the invalid SS#. I once refused to do that but the client brought in his return from the previous year which had been prepared by the local "IRS office". I am told by clients that they have been credited for the SS from those returns if they ever get a valid SS. In some cases they claim never to have gotten a valid SS but return to their country of origin and collect SS benefits when they reach retirement age.
You can't go back to your employer and get the W-2 corrected because they would be documenting the fact that they are breaking the law by employing undocumented workers. It has become a very big segment of some tax firms' business to file returns for "illegals" that hope they will use the tax returns to help with their efforts to get legal status.

If you are doing the return with the ITIN application the return should have no SS# on it must be mailed in as paper return with the ITIN application once the taxpayer receives ITIN# then returns in following years return may be filed using the ITIN# :) After reading all the answers above I've decided that some of are you are just plain ignorant! These so called criminials are here doing the jobs that all of our lazy butts wouldn't even dream of doing and they go to work everyday paying into our social security and child tax credit that they can't claim on their return so, if you want all the so called criminals to go home then get off your lazy butts and go out and do the work that you as americans feel you are too good to lower yourselves to do!!!

You'll have to get your W-2 re-issued with your valid ITIN. Using a bogus SSN is a crimminal offense and any attempt to file a tax return using it will result in the rejection of your return and possibly a knock on the door.
Since you're illegal, you should just go home. We have no issue with legal immigrants -- in fact we welcome them with open arms. Crimminals on the other hand are NOT welcome and if you are in this country illegally you ARE a CRIMMINAL be definition. Go home! (Come back when you're legal, but stay out until then!)

no,you cannot use a bogus ss# and they will catch up to you if its used,everything requires a ss# these days,you need to go and get a new number before filing anything,you will have to go back where you came from to get one though,i dont know any other way of doing this.dont go to the ss office wher you live,as soon as they find out your illegal they will have you arrested.be carefull whatever you decide,
