There is not nearly enough information to answer this question. I am not even sure that I know exactly what the question is. Were you in an accident and there were drugs and alcohol in your car? Were you charged in the accident? Were the drugs illegal drugs?

If you were charged in an accident and there were illegal drugs and opened containers of alcohol in your car, then it doesn't matter if you were doing them or not, there will be charges more than likely. If you were on your way home from the store and you had just picked up your prescription and a six pack and were involved in an accident, then that is another matter.

I would consult an attorney as soon as I could. That is the only way to get the correct answers to this question.

If you are the driver in said vehicle and the drugs and alcohol are in your vehicle it does not matter if you do them or not you are still responsible for everything in the vehicle while you are operating it.
