A pub nearby to my house has recently changed amangement and started with live music. This plays between 10pm and 1am every day, and the noise is too much. Furthermore, with the temperature increasing they have started to spread to their beer garden which makes matters worse. I was wondering what i could do about the problem? are there any laws/legislation to help me?

Or you can move!

Remember when you were young - didn't you just love it?

No, seriously, if you can't stop it with petitions etc, find a place in a countryside! You'll have plenty of silence interrupted only by birds and some wild animals. - beautiful!

Yes there is something you can do about it - you send a written complaint (keep a copy) to your local authority Environmental Health Dept - claiming that the pub is contravening the control of pollution Act 1990 in that they are causing a noise nuisance in contravention of your right to peaceful enjoyment of your property.

The Local Authority are duty bound to investigate that complaint - they may also ask you to record the level of noise - they have equipment to do this which you can loan from them. If the Council uphold your complaint they have the power to confiscate the equipment used by the pub which is causing the noise.

In addition, and as an alternative, you can also issue proceedings in the Magistrates Court yourself and again - if the Court upholds your complaint - the pub can be fined and/or have its equipment confiscated.

Furthermore, you can also complain to the licencing Magistrates and seek to have the pub licence withdrawn.

you need a petition from all your like minded neighbors. Disturbing the peace goes to the unalienable right not to be disturbed. Very basic and strong. IN America it is generally understood that 10 pm is when you have to turn down your music so others can sleep. I would say a good argument for you is to say you were their first and 10 or maybe 11pm is the latest they can be noisy.

Oh and if that doesn't work, sell you house and move before the neighborhood gets a reputation for having this loud place around all the time, and lowers your resale value.

See your local council environmental health officer.
He will monitor the noise & nuisance value to see if it is over the allowed limits. If so, they will have a amend their hours, noise, use of beer garden. If not, you will just have to get used to it.

Yes report it to the Environmental Health at your local council. Has anyone else from your area complained about the noise. If so, ask them to report it too.

the noise pollution laws and policies are different everywhere...

i would suggest calling your local council to detirmine the best authority to call...if you find out that a complaint can be lodged, speak to the management and inform them that you are planning to complain and that if they dont turn it down you will!!!

good luck to you!
