My brother was also abused physically and mentally by the same man between the ages of 5 and 15. He is now 30. Some of this is documented with my psychologist and once with the local police. I have not felt strong enough to bring charges against him until now. It has affected my confidence and my ability to relate to men in particular. Any answers on whether it is still possible to pursue this matter would be appreciated and is it worth seeking legal advice.

I think you should at least talk to a legal professional. It's possible there may be more victims than just your brother and you.
Also, there are plenty of advocacy groups that can give you advice on how to proceed with this.

Here are my thoughts:
In my personal experience, it is a detective who works out of the police department that can direct you. Either the District Attorney will take over or you will have to hire a personal attorney. You can find one for as low as $450 an hour if you look hard enough. Also you may look for organizations who will have an attorney that will do some pro bono work. Or take you on as a special case.

There is a time limit from the time of discovery of the affects the abuse had and the time you press charges. So their is a clock ticking but it hasn't run out.

I had a family member who abused others in the family and because of our case got 12 years in prison.
I believe criminals should be punished for their crimes.

It is not worth the pain of confronting him through a very ugly legal proceeding. But if you must just request a free consultation with a family law lawyer. You may find that you will have to pay for the attorney with just hopes you will win. I would seek counciling from a good psycholgist. It would helpp you to deal with your feeling and teach you what and how to move on with your life in the best possible way.

I don't know of any state-where 13 years later-you can decide to press charges. The statute for murder never expired. BUT even rape -there is no more than 10 years after the event that you can press charged. If you filed charged and he was recently found-the charge was already pending and active. BUT-if you just decided now- you can not. Get counseling.

Before you do anything, ask yourself what revisiting this will cost you. I was sexually abused by a neighbour and by a relative as a child (separate incidents, one recurring), and it took me until I was 28 to accept it and move on.

I did not have therapy, and I did not confront my attacker. I simply accepted that life is unfair and got on with mine.

If you go after your abuser, you will also involve your brother. Is he good with that? Will it hurt him? Will it help? If you charge him, and he gets away with it, can you deal with that? Put bluntly, do you gain what you need, or risk something you can't afford to lose?

It is entirely your decision. If you go after him, good luck and take no prisoners. Whatever you do, though, remember that you can wash it off in the shower and move on clean.

I dont really understand why you want to bring this up now, but I am sure you ahve your reasons......Anyways, I believe that there is some kind of limit in time,but I am sure that something can be done as if he did do theese thigns then he should be punished~! I would go to your local police department or even call them and see what they say...~! Good Luck~!

It's never too late to press charges. look at all the teachers from the 1970's that are being charged now for molestation. I would certainly seek some advice.
I live in canada so Im not sure what the laws are where you are.

You will have to find out about the statute of limitations laws where you live. It may be too late for you to press charges on him now, but he may be hurting others so you should try to do something.

Go on with your life. It's easy to keep looking back and using the situation as the conerpost for failure. Accept what has happened, accept that this is the cards you were dealt and that they sucked, and get on with your life.
