their child is automatically a U.S. citizen. But isn't their child also a Mexican citizen because it's parents are Mexican citizens? I read once about 4 yrs ago that an American couple went to Canada and she was 8 months pregnant. She gave birth while in Canada and their baby girl was automatically a Canadian citizen but also an American citizen because her parents are. They had no problem bringing her home to the states after the hospital released the mother and the baby and the parents had to sign 3 papers at a court house. Their daughter will always have citizenship in Canada and America. So why can't America have it like this with Mexico and after a Mexican couple has a kid here, send the whole family back to Mexico?

The Constitution needs to be changed. If the parent is here illegally the child should not be given automatic citizenship.

Yes, you are correct, Mexico does (or did, last I checked a few years back) consider the children of Mexican citizens born outside of the country citizens of Mexico as well.

Kind of shoots down the whole "breaking up the family" when deporting the illegal alien parents question, doesn't it?

here is another twist. the child can legally stay in the US. The parents are shipped back to Mexico. The child is a US citizen and can stay. Who takes care of the child? The US does not have to foot the bill for the child's deportation.

There are some places you can have dual citizenship, but in the US you have to choose eventually!

Nice way to get the kid declared a non US citizen, but it wont fly. The US doesn't allow dual citizenships!

DSS hunts for kids after raid: Feds scooped up parents as illegals at ‘sweatshop’

State officials are scrambling to track down children left behind at schools and day cares when their parents were detained by an immigration raid on a New Bedford “sweatshop.”

“The troops that stormed the factory are better at corraling people than dealing with family issues,” said state Sen. Mark Montigny (D-New Bedford).

Since 300 federal agents swept into the New Bedford factory Tuesday, reports have poured into the Department of Social Services and other agencies about children being left behind with babysitters, day-care providers and relatives with little information on their parents. ......

Patrick has called for help from Congress, alleging that DSS was denied access to some of the 327 detainees rounded up at Michael Bianco Inc. and now held at Fort Devens.

Sullivan said the governor had a “positive conversation” last night with Homeland Security Secretary Michael Chertoff, who is in charge of the Bureau of Immigration and Customs Enforcement, which conducted the sweep.

“The secretary has offered to work with us with respect to people ICE has identified as possibly having children,” Sullivan said.

ICE spokeswoman Paula Grenier said the agency has released 60 detainees for “humanitarian reasons,” including medical and child-care issues. Among those were three pregnant women and two who are breast-feeding. Most rounded up in the raid were from Guatemala and El Salvador.

The company’s owner, Francesco Insolia, 50, and three managers are facing federal charges of conspiring to hire illegal aliens. Insolia was reportedly out of jail and back at the factory working yesterday.

Workers were allegedly assisted in obtaining phony work papers, fined for talking and bathroom breaks and worked long hours to pump out military vests and other gear under the company’s $91 million government contract, federal officials allege."

A government contract no less. None were Mexicans!

When it comes to countries that deal with dual citizenship, it's all in the thinking of non US country. The US has no agreement with Canada. Canada may see the baby girl as an eternal Canadian (and American), but as far as the US gov't is concerned, she is American and only American. The same with anyone born on US soil. Unfortunate because it makes it more difficult to deport illegals as their children born here can't be kicked out any more than we can.

That's an interesting concept...Hong Kong is actually doing something about this problem. They are not allowing heavily pregnant mainland Chinese women into their borders for fear that they are taking up all of their hospital beds (due to the higher level care), and then not paying their bill.

The child is automatically an American citizen...The child will not have dual citizenship unless the child applies for it at a later age.

It is not the constitution that is wrong, it is the interpretation that is fouled up.. the illegal parents should not be allowed to leave the hospital except in a deportation bus..
