It does depend on the size of the employer's workforce. There are provisions for smaller businesses where the loss of one worker can be significant enough that it would seriously harm business, in which case you have much less leeway.
If you're working for a corporation of any decent size, you're almost certainly free to go. Even without the law, do you think any company wants to be known as one that won't let people join the National Guard?

I just went active from the Reserve Components. Under Law Employer have to let you have your 2-3 days off a month and 2 weeks out the year but they don't have to pay you. And if you get mobilized your job will be waiting for you as long as you provided notification of your orders within adequate time or as soon as you got them. How do I know? I've been there done that both Army Reserves, National Guard, now Active Duty.

Absolutely!!
An employer can not do ANYTHING that would discourage someone from being in the Guard or Reserve.
He has to give you time off to do it. He can not count that time off as part of your vacation time.
He has to hold your job for you, even if you get deployed.
If you have a job where a person gets a standard pay raise every year, you get it also, even if you missed a year of work.
If you were next for promotion and the promotion becomes available while you are gone, he has to give it to you when you come back.
If you get deployed for a LONG time, he can not hire someone and when you get back tell you you have been replaced.
Basically, anything he tries to do that screws up your life, you can go after him for it.
Tell him you are joining the Guard and will be gone for four months. Whatever arrangements he wants to make to cover while you are gone are his problem.

Yes, you can request military leave, but it is usually reserved for those who joined before they got the job. If you want to join while employed you will have to get with the Manager on that situation about whether your job will be there when you get back from basic and the school that you will have to go to after basic.

Yes, they do. You might run into problems if the company is smaller. Typically the larger corperations work hard to support military personel.

ur job has to give u the time off and they cant fire u it is against the law. u r given orders by the government that u r to b somewhere ur job has to let u go.

they can not fire you for any military leave. they are required to hold your job for you. they can get in BIG trouble if they fire you for going to training or deployment.
