We were supposed to be buying a 49k vehicle that had a GMS discount of 5k. That would make the vehicle 44k. We put 4k down and other incentives totaled 3.25k. This would put the price right around 37k. However, when we build the vehicle on the GMC websight we can only get the price to 44k. This means that we have purchased a 44k vehicle and did not receive the GMS discount, only the 4k down and the 3.25 in incentives. Do we have a right to the higher priced vehicle, money back, or what? We were basically shafted on our GMS discount.

You question is a bit confusing. You actually purchased this vehicle? Then you say you built it on GMC's website and didn't get a discount? The website will not build the GMS discount into the car, unless the vehicle was specially ordered for the discount. If that is the case, the invoice will reflect the discount and that is what the dealership has to sell it for. If it is a stock unit that you bought, the dealership has to apply for the discount, but they can get the right cost from GMC or use the right formula to figure the discount. If you have the proper documentation for the discount, and present it to the dealership, and it has not been used before, they have to give you the discount. If the proper information is not presented to the dealership at the time of purchase, they can not apply for the credit back, and won't give it to you. If there is a problem with the discount, they should tell you what the problem is. Even if you present the proper documentation after the sale, they can still apply for the discount, which they will give you after they receive it from GMC.

Only if it is in the contract, then you can claim 'Breach of Contract'
