Yes, but you won't be able to efile claiming your child, you'll have to mail in your return. You and the other person will both be notified by the IRS that two people have claimed the same child, and asked to prove that you are the one with the right to the claim. The other person will have to pay back the additional taxes plus interest and possible penalties.

To cause yourself as little grief as possible, call the IRS and tell them you believe that someone else improperly used your childs SSN to claim as a dependent. File your own return and be prepared to show proof that you are legally entitled to claim the dependent with that SSN.

If you know for sure that an unauthorized person did this, report them to the IRS.
