1. did the school phone you been for (she or he) did it to ask you is it ok
2.if not there are bracking the law
3. so phone up the school ask to speak the the head and ask who did the spanking you son and ask why did there do it
4. if there can not tell you take them to coart

That's NOT acceptable. Work with the foster mom (and I get that it won't be easy for you), but work with her. Make sure that EVERYTHING regarding that teacher's actions are written down, including whoever else was involved (like the principal, the police, any witnesses (even if they are kids), and guidance councilors at the school). Make sure times, and your son's reactions to this spanking is written down as well.
Teachers are allowed to do what is called "Stand in the place of a parent" which means they can act the way a REASONABLE parent would. This does NOT include spanking a child.
You can go to the School Board and request an investigation if the school does not investigate to your satisfaction. You can also sue, if you so choose... the teacher as well as the school board. Investigate first, and make sure you have all the facts straight. Be prepared for a LOT of lawyers... the teacher's union will also investigate and provide counsel for her (or him).
Good Luck. I'm a teacher... if I ever hit a kid, my principal would fire me... after she kicked my butt.

Maybe if you have spanked him a couple of times he'd still be with you. Sounds cold but it could be the truth. If you're son has ADHD and you didn't medicate him its called NEGLECT. Its the same as if he was diabetic and you refused to give him insulin. Its abuse thru and thru. Go to parenting classes, learn about what it is to be a GOOD parent and get some spelling classes. You totally misspelled half the words in your question! And there is a spell checker on here! God...forget the lawyer and work on getting your kids back.

Well I searched all over the internet and couldn't find anything specifically about teachers being allowed to spank children in the state of Michigan. However I am currently in school, studying to be a lawyer and I know for a fact that in MOST cases a teacher is never to touch a student in any way that is inappropiate or hamrful to the student. I also know that for states or schools that allow spankings, you need parent consent and without your consent it means she illegally touched your child. I defiantly think you should get a new lawyer who will actually help and send that teacher to jail. I also hope that you get your son back from foster care. First, I'd contact the school principal and ask her/him for a copy of the report the teacher filed. Don't get upset with them since this will only put them on guard. After you have a copy of it in your hands then ask, nicely, why it happened.
I'm pretty sure its against the law in all 50 states for a teacher to touch a child - even in a positive manner.
You might contact the legal aid office in your area and ask for an attorney referral. What the teacher did was wrong for any reason. Schools just don't do this any more. Thank goodness.
My son used to talk-talk-talk and there was no stopping the child. He got in so much trouble in school - so much trouble. Today, he still talk-talk-talks...all the way to the bank. He makes his living talking. Its a curse to teachers but a blessing later in life. We live with it and smile.
They say we spend the first two years trying to get them to sit up and talk and the rest of their lives trying to get them to sit down and shut-up.
And, for the record, if I didn't agree with a medication that was prescribed for my son - trust me - he wouldn't get it. We have to stand up for our children - even when other's disagree with us. Its a great thing you can talk with the foster parents. Stick together and tackle this. No one should touch your child for any reason.
Don't worry about what other people say. Really, don't. None of us walks on water - none of us.

First I'm sorry your babys were taken from you. my wife grew up in foster care in mich and she said it was hell for her. second i think it agenst the law all over the country for a teacher to hit a student in any way and you need to get involved no matter what the foster mom is doing, she my have them right now but you are there mommy and i think you have the right to protect your babys

The only help you can get is to be on the side of the foster parents and be nice to them. Let them help you and do not bad mouth them because you would not had the info without them. be friendly and helpful on visits and use this time for self improvement and be thankful the foster parents stood up for your children. I do not believe in parental spanking much less authoritive figures. sounds like the foster mom is a great lady she pulled through for your children and is a real Gem of a human and deserves a Mothers Day card the size of the Statue of liberty. Give her thanks and you too for caring

As far as I know, there's no law stating that teachers aren't allowed to hit children. Of course, there's a line between hitting and assaulting. There's also no law protecting teachers who hit students. If I were you, I'd do whatever I could to get that teacher the HELL OUT OF THAT SCHOOL. What gives this teacher the right to discipline your child in such a warped way? I can understand a time out or something, but not physical harm.

I'm in Michigan too. IT IS AGAINST THE LAW for her to spank your child. Michigan DOESN' T support corporal punishment. I'd file a report myself with the police, I'd make sure the court knew, I'd contact the principal at the new school as well as the superintendent. If I got no where with them, I'd go to the school board. Your lawyer, even the yes man that he is, has to let the court know. The foster parents are responsible for making sure your child is safe. They aren't doing their job. I'd ask that my child be put in a new school or a new foster home. I'm mom to 3..been where you are.

So, the state can now take your kids for refusing to medicate them? That's their answer to everything. Get a new lawyer and sue the state for taking them to begin with. No one should be able to dictate what you give your child (I assume that we are talking about meds for ADHD, or something similar?). And when you get your kids back, sue the school the state felt that he was better off being in.
