I’m wondering WHY you want to get your child emancipated. I’ve found that *usually* when a *parent* asks this question, it’s because they aren’t able to control the child and therefore they’re looking be relieved of their legal obligations / responsibilities regarding the child. Now, I don’t know if that’s the case in your situation, but IF it is…that is NOT the purpose of emancipation.

The purpose of emancipation is to allow a MATURE minor to possess some of the legal rights of an adult IF it would be in their best interest to do so AND they are capable of being responsible for themselves.

Emancipation has to be granted by a judge. In most states (with a *very few* exceptions) the MINOR, not the parent, has to petition the court for emancipation. The minor would have to prove that they are capable of fully supporting themselves--paying for rent, utilities, groceries, medical expenses, etc--completely on their own with NO help from anyone. They would also have to provide a *valid* reason why emancipation would be in their best interest. The court can require other things as well.

The court can deny emancipation for any reason that they see fit, including, but not limited to, their believe that the minor lacks the maturity to function as an adult. For example, if the minor has been trouble with the law, the court generally views it as an indication that they are in need of supervision…emancipation denied.

Emancipation is rarely granted in any state (despite what some people seem to believe).

I say all that assuming that you live in the U.S., but if not, then I don’t have a clue how minor emancipation is handled in other countries.

YOUR SON has to petition the court for emancipation. You can't elect to abandon your child.

Why do you want your son emancipated? That is usually something parents fight against.

You need to apply for emancipation before the court
and a judge must hear your application and grant it..

"Emancipation" is something that only your son can do for himself. He would be a legal adult, and free of YOU as well...

Emanicipate, with an E. He will be emanicipated when he turns eighteen. Or he can go to court and petition the judge.
