Torture should never be condoned, ever. But this whole argument is a little like closing the barn door after the horse has bolted. War inherently creates the conditions where torture, rape and murder (as opposed to combat kills) become permissible or at least nonpunishable in certain circumstances, sometimes even encouraged.
When a country makes the decision to go to war it must always do so knowing that non-combatants will die, rights will violated and if things are not going well the chances are the war crimes will increase as a result.
A soldier has a duty to protect himself and his comrades that probably takes precedence over all else when in combat. If that soldier has been told by superiors he and his unit are in danger because of those they may have in custody, what follows then, no matter how unpleasant, is simply human nature.

We do not condone torture...Like anything there is always that one instance and someone will blow it out of proportion, making the uneducated think it is an everyday occurrence.
It is NOT common practice, although it does occur, on a rare occasion. It would be the individual committing the abuse, not the Government or Military fault.
Courts Martial is no more a joke than our criminal justice system

Unfortunately, torture encompasses an immense array of activities, most of which are considered acceptable, there is often a fine line between pursuasive incentives and/or deincentives such as serving cold food to prisoners, not allowing family visits, sedating refractory individuals, giving the 'silent treatment' to, so it is not always pulling teeth and burning out eyeballs. What is not allowed on the British mainland should not be deployed overseas, morallistically speaking.

It is wrong that these courts Martial are becoming so public.
I realise that people want transparency, but these prosecutions should be held 'in camera' (Think is the term used) I would have an independent observer from the UN and of course the families involved, but not the press, with reporting restricted to the event taking place and the result.

No we do not condone torture, anywhere or anytime, and yes, Courts Martial are a bit of a joke I'm afraid. There should be no such thing as Courts Martial. There should be one Law, for soldier or civilian! As always, circumstances and situations should be taken into account, as they generally are, but there should be one Law for ALL!

Torture is never condoned. But let me answer a question with a question - if you knew you could save the life of your best friend by making a known killer REALLY uncomfortable, would you?

If it saves the lives of others then yes.If a kinapper reused to disclose the whereabouts of a loved one I would be happy to take it on myself and in combat the lives of comrades are more important then politically correct human rights of prisoner who is not even enemy soldier just another terrorist.

Court martials are a waste of time, so are war crimes tribunals.
The civilians who conduct them have no idea what it's like to be in a war zone.
