If it is because you are going through this then you shouldn't be looking at examples of what others have gone through. Instead, stick to the facts of your case, don't embellish, and don't seek to be punitive. Assuming you are already divorced, and you may actually get full-custody AND your ex has to pay child support, that is punishment enough.
Don't be vendictive.

You need to file in the Superior Court for anything having to do with custody, no matter where you live in the US. As far as "punishing the father", think long and hard before you do that. Make sure you are doing it for the well being of the child and not the vengeance of you. If he is doing something that will harm the child then, GET PROOF--if you are petitioning the courts, the burden of proof falls on you. Look up the US code (type in the tool search engine bar US CODE) for child custody rights, the check the statutes of the state you live in. Knowledge is your best weapon in these situation. If he is hurting, endangering or neglecting your child you can file for emergency temporary custody with the courts that will give you emergency custody with in 24-72 hours. Hope that helped!!! Well I didn't go for full custody to punish my ex. I won full custody because he was a crack head. I called child's services because on his last court appointed visitation he abused my son. They stepped in a he failed drug testing for an entire month. I took him back to court two years later, he had not seen my children during those two years or since he abused my son. I told him it did not matter what happened in the court room, he will never see my kids again. We went into court he agreed to sign over his parental rights and the judge replied good thing, cause I would've made you anyway.

Unless he is real "winner", you will probably not get full custoday if he is wanting some as well...If you can prove he is a horrible, horrible person, then you might have a shot... but otherwise, they usually give partial custody to both...Trust me, I've been through it... Wanted to "get" him so bad, he lied on the stand and was a total jerk! But in the end, he will always be my children's father, and they love him... He does treat them well, and now it has been 9 years...we can finally tolerate each other...
Piece of advice...DOCUMENT everything that he does...you may find yourself in court at a later date, and might want proof of what he has done...

You have to prove that the Father is not fit to have even partial custody. Just a thought, do you think that this may hurt your child? They should come first and your bitterness second.

Why would you want to punish your children? Afterall they are the ones that feel it the most. It may even take years to feel the effects.
If he has bad history,I am sure things will all come out in court and eventually things will catch up to him. I speak from expierence.
Your children need you and the example you are going to set. Only you can take this horrible expierence and make it better for your children if he is as bad as you say he is.

if you can PROVE he has a history; of drugs, abuse, something dangerous to the child, then you have a good shot at getting full custody... and he still has to pay child support.
full custody just means he has no rights, except visitation, and even that may be pulled if proven he is a threat or danger to a child.
you can request a mental evaluation/family evaluation (in most states), if the court sounds like they are not sure...
