Illegal? I'm not sure about that. I guess the issue is, does your infidelity hurt someone else? If the answer is yes, I think it is more of a moral issue than that of a legal one.
Any act that deliberately causes harm or pain to another human being is morally wrong. If you are considering cheating on a spouse, maybe there are issues in the relationship that are causing you to stray. Would it not be better to divorce or separate from a spouse before cheating on them?
The goal in this life is not to hurt other people. The more ways we can stop the hurt and suffering of others, the better off this world will be.

Your question is not specific so I will answer it in two parts.
In the aspect of Christianity, it is already "illegal" because it defies the natural creation God has put in place. One man-One Woman. To have sex outside the sanctity of marriage in either case of fornication and adultery is a sin.
In the aspect of the Government. The military already has it illegal. If you have an adulterous affair while in the military, they will discharge you.
Should it be illegal?I believe it should.
But on what grounds? The people will say. And if there is no moral absolute behind such a law, there will be no such respect for that law.
If you base it on Biblical reasons, then you must enforce it on Biblical law.

Even if I believed that this should be illegal, the question remains: how should society enforce such a law??? Do we create a special police force that will spy on people having sex then ask for their identification???
Something this personal is between the individual and the creator of the universe.

No. I aint getting married and I'm not going to stop sleeping around. If they did make it illegal I would go on a bender so big that they'd have to give me the death penalty. That would be ironic, executing a man for having sex?

Illegal? No. Some couples really do have open relationships. If you want to cheat you'll cheat, if you don't you won't. Sex laws don't keep people from doing anything.

yes, because the costs to society are so great. Adultery and cause divorce, which causes poverty, juv. deleinquency, high drop out rates and teen pregnancy. The costs of these problems are paid for by the rest of us who choose to live moral lives.
