We rent an apartment in NC.
My husband works in SC. I do not work.
Do we have to file for NC tax return, since we are residents only, but do not work in the state?
(We have already filed in SC)

You would need to file a NC resident tax return, as all your income is taxable by your home state. You should receive a tax credit for taxes paid to another state (SC).

Every resident of a state that has income tax must file a return for that state. Yours husbands income will be taxed by both SC and NC. However NC will give a tax credit on the money that is paid to SC. This will avoid paying the same tax twice.

I assume your return in SC was filed as a non-resident. Since your husband has income, even though it's not from NC, and he's a resident of NC, then yes, he'd have to file a NC return.

Look in the instruction forms for NC state papers. There will be a section in the beginning labeled "who should file" that will list everyone that is required to file. It varies from state to state, but some states of residency will still want you to tax you on money earned anywhere else. Chances are, you may not have to worry about the NC filing at all.

You have no earned income for NC - so no need to file a state tax return.
