5 yrs ago, a hospital took us to court for an ER bill (daughter broke her leg).we had no insurance but was less than $100 over qualified for medicaid. we had no means to make payments, we have 4 children. anyway, the amount of $1500 was sent as a judgement on our credit report. now, after 5 yrs, we have a chance to clear up some credit, and thought we should take care of this judgement first. ok, if we pay off the hospital, can we ask them to remove the judgment? the amount is 80% of our negative credit. we had always thought that creditors shouldn't use medical against us, but oh, yes, they have! if the judgement is required to stay on for 10 yrs, why should we pay if it will have no effect? and, if anyone is asking, you will get sued in arkansas for unpaid medical bills, even emergencies! why we moved back to texas.

The hospital cannot remove a court judgment.

Get a certified copy of the judgment.

Look over the judgment for "any" discrepancy between what is recorded and what is being reported by the credit reporting agencies (CRA's). If you find a discrepancy, use the following "example" letter and make it your own. Then send it to the CRA's:

On my credit report # xxxxx the following entry in the public records section is incorrect.

I have no such judgment of record from this Court for this date from this creditor for this amount.I have certified documentation from the Court to support my dispute.



If the CRA's do not delete, file an online complaint with the FTC. Include in the complaint that you had properly disputed an incorrect public record and the CRA's did not delete or correct it.
Then re-dispute to the CRA's with a copy of your filed FTC complaint.

Do not send the CRA's a copy of your certified copy of the judgment unless and until you are asked for it in writing along with the reason for the request.

If they claim the furnisher has verified the entry, before you send a copy of the certified copy of the judgment, you have the right to request the name and address of their furnisher for your records for future actions

Be sure to opt out and update the personal information on your credit reports - remove old address, especially if you had moved since the judgment, before you send your dispute to the CRA's.

Keep in mind that there is always the chance that the CRA's "will" correct any inaccuracies.

Judgments are public records. The hospital cannot remove it from your credit report. However, after you pay it, it should be marked as paid.
