Question - if someone does not want to be in the military anymore due to a second/third tour and instead of going awol and perhaps to prison.

What if you stated you were gay! If you did that, wouldn't you be removed?

I can only answer this from the Army perspective. Some of the other answers already posted I question as legitimate, but since I'm not familiar with the way the other services interpret the law, I can't quite say.

The rule of thumb for homosexuals in the military can be summed up in the acronym "SAM"...Statement, Act, Marriage.


Statement - You make a statement that you are gay. Remember, the law is "don't ask, don't tell". By making a statement, you are breaking the "don't tell" part. As the general opinion by the rule-makers (that I do not agree with) is that serving as an open homosexual is bad for unit morale, the fact that you are willing to 'out' yourself by telling or making a statement is enough to have you kicked out.

Act - You are caught in a act of homosexuality, either active or passive.

Marriage - You enter into or attempt to enter into a martial union with someone of the same sex


Now, as far as using "I'm a homosexual" to get out of being deployed...it's been tried and failed. If you are not currently in a state of mobilization and want to get out of the military, however, one of the "SAM" things probably will work for you...just tell your commander that you have had a change of heart and all of a sudden enjoy same-sex encounters. He'll have to start an investigation...if you're caught lying, however, be prepared for the consequences.

the rule does not say you can not be gay, it states you can not act in an overtly "gay" manner. i.e. sex with the same sex, relationship, porn etc...

plus it is not necessarily an automatic discharge, there has to be an investigation and a court martial. and if the person is found to be lieing that's a dishonorable discharge and possible prison time.

whether or not the person is found to be lieing the fact is from that moment on the person has a Dishonorable discharge in their record and it will make getting a job that much harder.

who ever the person is should suck it up do their job and live with thier choices.

other wise they are just buying the coward's way out and for the rest of their lives the mark will go with them.

If someone was so much of a coward to say they were gay to get out of the military, let them go. I wouldn't want them fighting next to me.

i once was in a very simillar situation, pleed psyc, go to your unit chaplain/padre/preist, and cofide in him that you cant handle another tour, that your thinking of self harm because of the situation you are in.
while alot frown on this, think of it this way, millitary life is not for everyone, and what would people rather, a dedicated soldier on the front line?? or someone who is likely to jepadise the saftey of themselve and those around them.
in the mean time, keep your chin up.
if alternatively you wish to stay in the service maybe try pushing to get a posting to a non combatant role??

You would have to do something that is considered gay to be kicked out. If they do discharge you, they put it in your record as a mental defect discharge. That way it will not be known that you are gay at any new jobs.

That won't work trust me..I knew a guy who tried that and was told by his commander i didn't ask so don't tell me..
The only way you may get discharged is by being caught in a homosexual act...Just saying you're homosexual isn't going to get you discharged.

Should not have joined the military if they weren't ready to handle it. I think they are a "sissy" or a "wimp" or a few other choice words come to mind...coward perhaps.

I don't think it would work. I remember in boot camp at MCRD Paris Island, SC, a recruit who told this to one of the DI's because he couldn't take it anymore and wanted out. The DI grabbed his crotch and told him to prove it. Good luck.

you have to prove it. follow by an intensive investigation sir. the other thing u can do is claim that u are no good in the head and yet again you'll go trough an investigation.

No. Saying you're gay doesn't matter. Getting caught in the act DOES.
