If you follow him through the intersection, then yes, you are both breaking the law.
Just because he didn't stop where you thought he was supposed to doesn't give you automatic permission to follow him through the intersection.
I can think of a number of intersections where if I stop at the painted line, I am still not far enough forward to clearly see around the corner. I know of a few offramps that are like that. If you stop at the line, you can't see over the bridge. So sometimes, I will admit to not coming to a complete stop until my car is far enough forward to clearly see over the bridge. If you were behind me when I did this, do you think it would be safe to follow me out into the intersection?

If your stop with your front wheels are on the white stop line, It's perfectly OK to go if the coast is clear. Do not roll or follow the car in front of you unless you have already come to a complete stop. On a two lane road it's against the law to pass on the right at if there is a stoped car in front of you. If there is a car turning left position yourself toward the right hand line so cars behind you know you plan on proceding straight ahead.

When he goes, just stay put, you're stopped in the right place.
You can't just "tailgate" through on his turn, though. If it's an all-way stop, you have to let the other cars have their normal turn, and then you go.
Even if it's all clear, you should "dwell" at least 2-3 seconds, while YOU look both ways, again. The time may be annoying, but if that 2-3 seconds saves you a $250 ticket, you just paid yourself $360,000 an hour tax-free.

No, you don't stop again, but you wait for him to cross before you start. by the way, you should stop behind the line, not at the line. In another situation, another car could zoom out of nowhere, going at a high rate of speed, and the guy in front might decide he has to back up. Always think ahead, and drive defensively.

Since you're already stopped at the proper point, yes, you can proceed when it's safe. However, you must make sure that the car that was in front of you has cleared the intersection before proceeding.

If this is all-way stop and there are other cars - wait for your turn as you normally would. Otherwise - proceed, you already came to a complete stop, which was required by law.
