I was wondering if there a legal provision that allows ship captains who catch modern day pirates to hang them by the yard arm. I say there isn't, but my friend keeps saying there is.

Who's going to say anything if the captain fortunate enough to survive an attack by these scumbags, doesn't give them a ride back to port? Its not really an execution if he gives them a chance to 'swim for it', is it?

There are generally accepted maritime laws that govern conduct in international waters. These have the effect of being treaties between nations, and guidelines for private individuals.
