Im a witness in a domestic violence case and I am also the victim. If I choose not to testify or even show up what can I be penalized with??

Don't worry about it. If you fail to show up the Judge will send a driver over to pick you up. Might even get to spend the night!

Get a spine - wimp. Domestic violence-testify and find a better class of loosers to hang with.

I believe that you may be charged with comtempt of court. Who subpoenaed you?
If it was the D.A. you should call their office and inquire before you decide not to go.
If you are the victim do you have an attorney?
Honestly though - you should go and testify.

Although many abusers apologize and claim they will never hurt again they will and they do - this is part of their manipulation of the victim.

They wear them down and eventually strip them of all self-confidence and self-esteem.

When you love someone you NEVER hit them or hurt them in any way and that includes verbal and emotional abuse.

If you do not show up for a subpoena, you are held in contempt and a bench warrant will be issued for your arrest. It does not matter if you were the victim, the state is prosecuting the case, and they don't take to kindly to people not showing up to court. If everyone could just not show up, our justice system would collapse in on itself. You could also be charged with obstruction of justice, but that depends on how bad they want you to see jail time.

With a subpoena, there is yet another decision in that a prosecutor ought to seek for an order affirming you to be a textile witness and then carry you in reformatory till the trial. Cool, huh?

You may end up in jail.

Just curious: if you are the victim of a crime, why WOULDN'T you testify? If that happened to me, I'd be soooo eager to testify and show up in court to nail that bum's butt. Just curious.

Most likely a warrent will be issued for your arrest for contempt of court.
