Each state is different, but there are some strict laws about daycare even if you are not licensed. You should check the laws in your state as they may tell you what you can or cannot do.

I did daycare for 13 years. I suggest that you put the sleeping room downstairs. Simply because you will need to check on them every 10-15 minutes and that will make for alot of running on the strairs. Sometimes its easier to hear things that may be going on while they are supposed to be sleeping if there down instead of upstairs

The sleeping kids should be on the same level with you and the activity. You don't want them falling downstairs or smothering.
Keep in mind that infants who endure more than 10 hours a week separation from mommy are seriously messed up emotionally, intellectually, socially, and physically (far more sickness, including surgeries!) They need to bond to only one person (supposed to be mommy) and so if you take infants or toddlers into your day care, you will be part of destroying a kid's mental health. And, you will have a child who feels abandoned, then bonds with you, and then must leave you every afternoon. It's very traumatic and unethical to be a part of. No one should agree to take part in harming infants and toddlers to this degree.
At a minimum, if you sign on an infant or toddler, you must make a commitment to stick with that kid for years, because you become the de facto mother.

Depending on where you can hear and reach the children in time. In any case, I would put them down stairs. It is easier and some children can surprise you by getting out of cot, then the stairs can be hazardous to them if you haven't install a stair guard. If you haven't got one please do so immediately. By the way have you got any kind of training in setting up childcare in your home and attending workshops? All these are addressed during your training. Good luck.

definately downstairs so you can check on them all and could certainly not cause you compliacations with fire regulations then. if sleep room was upstairs you may have a problem of children of certain ages being left up there to sleep!

i would put it downstairs that way you can go in and check on them often and it removes the falling down the stairs issues those baby gates are not 100% trust me

I would go for downstairs, then you can check on all of them at one time, and it's more out of the way, and hopefully more quiet.
