When driving in California, will you get a ticket for a passenger not wearing a seatbelt, or will the passenger be ticketed? If you were specifically stopped because a passenger was not wearing a seatbelt, it seems that that driver will be ticketed. On the other hand, if the driver is ticketed for something else (e.g. speeding) and if a passenger was not wearing a seatbelt, the passenger will be ticketed.

Can anyone verify these? Thanks.

In the past, you (the driver) would be cited only if the pass. is under 18, and if over 18, THEY would get the ticket.

I have heard that that is changing soon to where the driver gets the ticket for unbelted adults, which I think is total B.S., but what are we going to do?

Yes. You can because I have LOL...

In some states ( NH ) You dont have to wear a seat belt if you are under 12, so... Then the answer would be no. But Yes, the passenger will get a ticket.

It is the drivers responsibility to make sure all passengers are belted in. The driver gets the ticket.

In most states the passenger will be ticketed as long as they are not a minor but I am not sure how the law is in Cali. No offense but they have some assenine laws there but then again so do other states. Try the DMV website they could tell ya or ask a law enforcement officer they are your best bet.

The way I read the new California law is that the operator of the vehicle receives the citation, since it is his/her responsibility to ensure that all passengers are buckled in. You can see more at the web site I've cited below:

My first week in CA I got pulled over for inspection, my husband was not wearing a seatbelt. He got the ticketed for the seatbelt, and I got the warning ticket for transferring my plates and registration.

the driver holds all responsibilites of the passengers in their vehicle, so if someone isn't wearing a seat belt. the driver will be ticketed. fair or not.

Yep. They are sticklers for it in the Peoples Republic of Kalifornia.
