me and my boyfriend are talking about having his son's mother sign away her rights because she has left the picture anyways and we are wanting me to adopt him. What is the procedure to do this.

Go to the courthouse, and pay the fee (where I live, it is $70) to get guardianship first and foremost ----- that is if the biological mother is willing to sign him over --- either way, you will need to get an attorney, but the reason I said to get guardianship first, is because if you have legal guardianship and no contest from the biological mom, then you should be able to pay a flat rate for an adoption-that is what my hubby and I did for our nieces and nephews, and it saved us $2500 in attorneys fees that we handled very easily ourselves. Go to your courthouse first and foremost, though, because every state is different. Good luck, and good for you taking on such a responsibility!

You should contact a lawyer. If you two were married it would be a step parent adoption which is totally different. Also the mothers willingness to sign away her rights plays a major role.

You have to, have to, have to get a lawyer. She can't just sign her rights away in a letter and get it notarized. The lawyer will walk you through the rest.

You could file for custody under abandonment laws. Depends where you live.
