If some commits a terrible crime against another person-like murder. Then the victim's family has a right to kill that other person. Then that person's family will want to kill the other family and this will go on 'ad infinitum'.
The purpose of the "LAW" is to execute the murderer so the family will not "NEED" to avenge their loved one's death (or rape, or kidnap) . This breaks the cycle or revenge, and keeps the victims family from being victimized twice or more. When the "LAW" allows a guilty person to go free, then the family of the victim feels that justice has not been done, and the whole thing starts over again. We have a death penalty law-but we are abusing it by not using it. How much or our crime today is either a revenge for an un-prosecuted wrongdoing, or an act by a repeat offender?

Murder is a bad choice yes, but there are a sea of bad choices in life. No one would know what you were talking about if there was no way of differentiating between all the different ones. Thus, there are different categories and levels of bad choices and they are each members of the bad choices family but they do need to be defined separately. So murder, rape, cheating on taxes, etc.. can all be bad choices but no one would know which you were referring to unless you have labels for their separate kinds of bad choices. No all bad choices are crimes because our society dictates that only things with negative ramifications for others and society as a whole are punishable by the society.

There are many bad choices in life. For our legal system to function, that specific crime requires a limited term, such as murder. Note that there are different levels of the crime, referred to as First Degree, Second Degree, Third Degree and Manslaughter.
In short, the answer is that the term 'bad choices' is not specific enough to be useful by our legal system.

Just because I choose a hamburger over a celery stick for lunch...obvious bad choice...I shouldn't be charged with a crime.
The minute we start charging people when a choice is to be made is the day we have given into Big Brother.

I don't know Midge. I do not believe in capital punishment though I know in some cases we have to except it as a necessary evil (such as Saddam). I would be happy with life in prison with no chance of parole for capital murders. I would like to see NON-VIOLENT crimes treated through community corrections and those people be made to repay all their expenses and the cost of what they have done. But...as usual...I am the liberal outcast.

because murder is the name of the bad choice made. Just he made a bad choice, is way too broad of a crime. Although most crimes could be attributed to a bad choice, all bad choices are not crimes.
