Is there some law being broken for me being punished for standing up for my rights?My employer is more concerned with production than my health,and I am ignored,chastised for getting a lawyer,so that i could fight for the benefits I should have gotten:Now because I took an out of court settlement,my employer feels if I was really ill I would've taken it all the way to court,and really sued them,so now my record at work presently is"refusing to return to work",even though I'm on disability with 4 doctors treating me and 'I'M AWAITING SURGERY...HELP!!!!
the charter of rights and freedoms says"every individual must be treated equally"I have been discriminated upon for what I did...

Talk to the Labor Relations Board and tell them your problem. If an employer flags you as a whistle blower, you are entitled to rights as an employee. All allegations in your record must, (upon request), must be substantiated by documentation. With that in mind, you might consider a "Defamation" Suit if this prevents you from seeking and/or obtaining future employment in the field you are currently in, especially if you are in a "Specialty Field" where you field of expertise is required. You might also consider a "Reverse Discrimination Suit" . Good luck with your surgery.

It's not discrimination if it's being done against you as an individual, rather than against you solely because you happen to be a member of some definable group.

Equal protection doesn't mean everyone needs to be treated equally. That's an incomplete statement and an incorrect interpretation. Equal protection means that everyone who is in the same situation ("similarly situated") needs to be treated the same, and that distinctions cannot be made based on arbitrary unlreated characteristics (race, gender, national origin, sexual orientation, etc.)

But if an individual is being mistreated, not based on their membership in some group, but based on the specific factual situation of that individual, that's not an equal protection issue.

Whether it's legal or not depends on the laws of your jurisdiction (state/province/country), and you would need to ask an attorney or solicitor licensed in your area.

Ok, yes you are, but honestly the minute you hired an attorney to sue your company did you not realise your time with them was over.

The last time I was invovled in a law suit ( I was just the witness against the company) the 3 people sueing and myself were all fired for "other" reasons.

This is what happens, sorry but it is called pay back by the company and they will find a way to get rid of your sooner or latter, may as well face it

You should talk to your lawyer about harassment and unfair treatment. This is sadly more common than it should be, and if your employer is unfairly discriminating against you for health issues with any sort of proof, they should be responsible for any wages lost because of this.

Again, talk to your lawyer. I'm no lawyer myself, and I can't offer legal advice, but you sound like you could use some.

did you sign anything when you took an out of court settlement? you still should be able to get some financial support until you get better. if they say you are refusing to work and you are on disability than you should see a lwayer because somethings not quite right.

time for a lawyer plain and simple.

they have probably done some actuary statistical study on you and decided that you are not worth it.

i would also consider notifying the media to your plight so that hopefully the executives at your organization can explain their decisions out in the light of day...
