my son was knocked out in the pub last night,i have just been to see the landlord & he has not banned the person responsible & i dont think he will because he is a family friend. is there any way i can force his hand,what are my rights. my son is ok i took to the hospital for a check up and he is fine. what about the licence victuallers association ,my son is not willing to involve police(more fool him).any ideas please?

You can object to his licence at the Brewster sessions a special licensing court held each year to grant and renew licences.The licensed victuallers association is an association which licensees join not a legal body and would support their member.

if you was not here at the time of the incident then basically you have your sons word for how it happened, why is he so reluctant to go to the police, is he underage, has he been in trouble before etc...what started the whole thing which ended with him getting smacked.
Yes you can approach the LVA with a written complaint and you can also find out if the pub is part of scheme that was brought in about 4 years ago where if a person is convicted of an attack on the pubs premises then ALL the local pubs in that area will also uphold a ban to that person............IF the pub is part of that system then you might find the LVA is much more likely to help out as the LVA has shown they wish to stamp out violence etc either in their pubs or towards their staff...........

you can't force a private owner to ban someone f/ his property the only thing you can do is maybe threaten the pub owner w/ a lawsuit if he refuses not to ban this person, i also agree that your son needs to press charges so that something is on record b/c if you choose to tangle w/ the pub owner chances are he(or someone in his interest)is gonna mess w/ your son!

Since most bar fights are between two drunks who are equally at fault I would say who cares. If you are that concerned about your son having a place to drink either teach him how to fight or find him another bar to get drunk at. Maybe your little angel of a son is the one who started the fight and he should be banned. How old is your son anyways? If he is old enough to drink I don't think this should be mommy and daddy's concern. Let him handle it on his own or he will never grow up.

He could have gotten the other guy charged for assault but you say he doesn't want to involve the police. Smart on his end if he wants to not look like an idiot and ruin his reutattion. But I suspect that he already looks like that since he is old enough to be in a pub but has a father who is running around trying to defend him.

get ur son to get put an injuction against the person responsible then if ur son gets to the pub fisrt the guy won't be ablke to go newhere near it
however if i was ur son i would find a better place to start drinking

You can complain to the brewery that operate the pub, the council, and the body issue the licence to serve alcohol. You can also complain to the police yourself, they won't do anything but a log of your complaint will be made.

You can sue the landlord for liability and/or damages to your son, have the court ban him from the premises, other than that i don't know.

if you don't want o get police report and then the possibility of a peace bond then your recourse is to visit another PUB
