My girlfriend and I were together for over 2 year already. I was very much in love with her. She is in love with me also. I started dating her since she was a freshman and I was a senior. Now, she is a junior and I am in college. 5 days ago, we had sex. 2 days ago, I broke up with her because I caught her cheating with another guy. I was very heartbroken when I saw her with him. and now, she is going to charge me for statutory rape. But I wasn't forcing her to have sex with me. It was a mutual decision. During the act, she never told me to stop. I just hope that she isn't pregnant for what I did though.

Statutory rape has nothing to do with consent, so you have no defense there.

However, she's also probably already past the age of consent (Juniors are usually 16), if so then the charge will probably be dropped.

Your state's law may vary though. If you are more than 5 years older than her, you may have a problem.

Depends upon what state you live in but if she was under the age of legal consent you are screwed. In most states noone under the age of 18 can consent to sexual intercourse legally. Even if she didn't say no and you didn't force her in the eyes of the law you still raped her.

That's why it is a good rule of thumb to never have sex with someone under the age of 18. I will also bet that now that she's reported you there isn't any way for her to stop the charges even if she changes her mind.

get all the evidences which kan prove ur were dating her since 2 year
1.phone bills
2.testimony from best and close family
3.any cards she sent u
4.any gifts she gave u

koz if u go to a lawyer he or she will ask u all that just to pruv she was in a relation wiz u at that time

try to find out when she made the complain at the cops
if she drinks then u've got a chance playin that she wanted it she was drunk lawyers kan help heaps bro depends on the money u've got

Sounds like you shouldn't have had sex with her! Or broke up with her, you should have talked to her about it instead of breaking up with her, now she's being an evil ***** to get pay back.

You should have done a thorough check on her are you saying that she was underage when you had sex with her. if yes she got you bad. Check a lawyer

oh my..i'm sorry but she is a total *****. stand your ground and be confident that you didn't do anything wrong. i can't believe someone could do such a thing...you deserve way better.
