the car was second hand but bought out of a garage it also has had 3 timeing belt and it has only done 62000 miles should the garage have told us about the cat d insurance

Yes they have to tell you for insurance reasons. I buy and do up cars from the Auction and some are CAt C or D. Before I sell them they have to have a check by VOSA before the DVLA will even give me a log book for them. I always disclose this to potential buyers as it does make a difference on your insurance premiums.

As a second hand car dealer they should be even more aware of things like this than me!!!!!!!

I would go to the citizens advice and find out exactly where you stand and then go back with all the information to the garage and demand your money back.

The only legal requirement a seller whether private or trader has, is to ensure the car is finance clear. He doesn't need to inform you if its been an insurance write off.

Put into perspective, 75% of cars over 5 years old have had an accident of some sort.

Technically it can be repaired, and is inspected by VOSA before it's allowed back on the road. The only onus on the dealer is to see that it is roadworthy at the point of sale, which it probably was. The problem will be, if you try to challenge him he will say he told you all about it. His word against yours, unless you have witnesses to confirm you specifically asked him about it and he denied it.
Regarding the timing belts, either it's a real lemon or a previous owner had been hyper-cautious.

They should of done if they were honest, but legally it was probably sold as seen and the garage will just say they didnt know either, you know thats bo***ocks but that is how they get away with it. You should of done an HPI check this would of shown it was a cat d write off

Everyone has different laws, so i dont know what it is for you..

But if you asked for the history, and they lied, you might be able to get your money back... but you will have to go through a 'higher power'

If you dont have it in writing, which im assuming you dont, then its going to be hard

I dont think they have to tell you about the history if you dont ask

They shouldnt even have been selling it! You should go to your local citizens advice bureau on this one.
A friend of mine had a long legal battle after discovering her car was actually two welded together when buying from a 'legitimate' garage!

Depends if there are laws about disclosure where you live. Might have a case if you can prove the garage did the repairs.
