When you say "full" custody what is it that you are asking? Do you want your ex's parental rights taken away or is it that you want your child to physically live with you and have visitation with your ex. There is physically custody and legal custody. Physical means that you are the child's primary care giver (they live in your home) and the other parent has visitation with the child and shares in any major decisions of the child (major, not every day stuff). Legal custody means that the other parent has no legal right to the child anymore and that is extremely hard to get. I think you need to talk to a lawyer or a family court office and be very clear on what it is you are looking to do. Good luck!

Ignore the last answer please... I had to deal with this three months ago with my daughter. The answer is it depends on what state you live in. I was petrified that I was going to have to share custody or give visitation to a man who was physically and emotionally abusive, in front of my daughter and his other two kids. However, the law in Georgia says that since we are unmarried, I have sole physical and legal custody. He basically has no rights, now, that doesn't mean he shouldn't see the kid. I let her dad come over pretty much as he wants, but he stays in my house or I take her to the park to meet him. He is not allowed unsupervised visits. I would call a free legal hotline or website to see what exactly you need to do, or if you don't need to do anything at all, like me.

First you need a lawyer but be aware that while you may get total custody of your son your ex will STILL have vistation rights. You can NOT keep a non-custodial parent from having visitation unless it can be proven in court that they are unfit, and usually those get supervised visitations. Also be aware that child support is NOT payment for visitation. Even if he pays you nothing the non-custodial parent is still entitled to visitation of his child.

So you hooked up with some guy, pumped out a few kids, figured out he's not what you're looking for, so screw the kid, he don't need a daddy. In fact, you'll just keep him away from his daddy so he has no good male relationships, just the guys that stop by to poke ya after they hit the bars, cause they sure don't want the pre-made family that you built and trashed...
Heres a better idea. Grow the hell up. Accept the fact you created a child that didn't ASK nor DESERVE to be burdoned with your crap and establish an amicable relationship with the guy instead of being a moron and hurting the child to satisfy your own sense of vengence.
