My boyfriend has the same problem. He has a court order stating that he can claim his daughter every other year. Her mother still claims her. He has to go through the process of filing a paper return, and sooner or later the IRS will catch up with her. Best bet is get a court order, to protect yourself.

No, only one person can claim the child.

Which one of you had him more that year? The time spent is never 50/50...the IRS allows for the counting of time (down to minutes) to determine who had the child more.

No. The IRS will come after you if you do. The best way to solve this problem is by the two of you taking turns claiming him.
