They are sold in both the sweet section and the biscuit one in our local supermarket so I quess it's up to you to decide as they obviously cant!
To me it's a biscuit ( that's a cookie to you Yanks who are in All English Question mode)I have mine with hot drinks and I love the new Dark Chocolate! I'm off for a break!

In the supermarket where I shop, they are in the chocolate bar section. I think that they are more chocolate bars than biscuits

Id say kitkat is a biscuit because its something you have with a cup of tea as well as anytime even on the advert

Well, since you suggest biscuit, you must be British because in the U.S. a biscuit is a type of baked bread made from a dough of flour and water. In the U.S. "cookie" would be the option.
Having said that...it is truly neither of your options as it is a combination of the two. It is a chocolate covered biscuit.

it's classed as a biscuit. next time u are in a supermarket have a look at where they are displayed. u will find them in amongst all the other biscuits, not the chocolate bar section.
