The team owner owns the car number, the driver owns the sponsorship, therefore, when Jarrett went with Michael Waltrip he took the UPS sponsorship with him, but the car number 88 stayed with Robert Yates Racing. The number 44 was available and Waltrip selected that as one of his car numbers for his new team.

Because Robert Yates Racing owns the #88. DJ does care what number, car, or even team he is racing for.. the 20 mil from Toyota and MWR is just his retirement plan. He has made a career out of driving around in the middle of the pack collecting sponsor money. When this is done, we will not have to see him anymore, except in the booth.

So Dale Jarrett had changed to Robert Yates Racing to Michael Waltrip Racing. Ricky Rudd had replaced him, that's because he changed to UPS to Snickers.

The car Number is owned by the team owner not the driver, He left his team to go and have a frustrating season driving Toyotas, only hired him because he could keep his sponsor and he has available Past Champions Provisionals he can use to get Toyota into a few races this year anyhow

he changed race teams so he had to change his number yates owns the #88 and would not give that number to waltrip racing so they put #44 on the car

Changed rides. Some numbers are owned by the team, not the driver, so, by him leaving a certian team, he may not have been able to take the number with him. It has happened to a few drivers, Micheal Waltrip, Elliot Sadler, Casey Mears to name a few.
