I used to work for a real estate company last year and they have since closed down. I've been waiting for my W-2's and they have never came. I contacted the IRS and they told me to contact my old business owner so I called her a couple of weeks ago and she said that she doesn't have money to pay someone to get them together so I'm pretty much screwed. I must have my W-2's to file my taxes otherwise I'll get in trouble with the IRS and I have to figure it out before the end of April. Any suggestions?

If you still do not receive your W-2 by February 14th, contact the IRS for assistance at 800-829-1040. When you call, have the following information:

Employer's name, address, city, and state, including zip code.


Your name, address, city and state, including zip code, and Social Security number
If you misplaced your W-2, contact your employer. Your employer can replace the lost form with a “reissued statement.” Be aware that your employer is allowed to charge you a fee for providing you with a new W-2.

You still must file your tax return on time even if you do not receive your Form W-2. If you do not receive the missing information in time to file, you may file you may use Form 4852, Substitute for Form W-2, Wage and Tax Statement. Attach Form 4852 to the return, estimating income and withholding taxes as accurately as possible. There may be a delay in any refund due while the information is verified.

If you receive a Form W-2 or W-2C (corrected form) after you have filed your return using Form 4852, and the information differs from what you reported on your return, you must amend your return by filing a Form 1040X, Amended U.S. Individual Income Tax Return.

Unfortunately, you're stuck for awhile.

You'll have to wait until the IRS investigates them and determine that they have withheld monies from employees and not issued W-2's; who knows whether they ever submitted the withholdings.

Sounds like this business was a total scam. The only recourse you have is to get a lawyer and either sue them or have them investigated by either the IRS,
the state that you're in or the Better Business Bureau.

You will be able to file this year - just show everything except your W-2 income. Attach a letter to the back of the return describing what happened to the business and not receiving a W-2. Indicate "See Letter Attached" on the
Wages line of Form 1040.

If you ever receive a W-2 from this business, you will then file, but you will not be subject to penalties and interest for either late payment or late filing because you covered yourself in that letter.

Call the IRS again. If you have your last pay stub so you know what you made and what was taken out, they should be able to help you.

you'll have to come up with your wages and withholding on your own, from your pay stubs, and file your taxes using a substitute W2.

whom ever you are going to , to have your taxes done should be able to put in your ssn and pull up all the info they need
