It's a creditor assosiated with 53 bank. It's a long story, but I don't believe the charges from the bank are correct. In fact Im sure a court would side with me. Anyways they sent my account to a collection agency who calls me 3-5 times a day MTWRFSS. Every single day, never a break... This can't be right. What can I do please. I'm not even sure if the credit agency will give me their address.....

Are you in the U.S.? If you are, read the rules of what a collection agency can and cannot do. (link below) One thing they cannot do is harass you and calling 3 times a day is harassment.

You will need to send them a letter stating that you do not owe the money and that they are not to call again.

They then have to send you proof of the debt.

Read the link below carefully. It contains what a collector can and cannot do under federal law. If you believe they are violating the law, file a complaint with the Federal Trade Commission and your State Attorney General's Office. States all have a fair debt collection department within the attorney generals office. Go to your states website.

First, look up their business office address. If you know the name of the collection agency you can google it and/or do a BBB search (bbb.com) to see if you can locate a physical address. If you can't find an address that way then answer the phone the next time they call, DO NOT let them control the conversation as you have rights and you need to let them know that you know what they are. Demand a mailing address, account number, and any other pertinent information you may need and send them a limited cease and desist letter that states that they can only contact you by mail regarding the account. Send that letter certified mail return receipt requested and if they continue to call you after you have sent that, you can tag them on violations of the FDCPA. Once all of that is done you will want to ask for validation of the alleged debt but that is a whole different process.

Send a certified letter to the collection agency requesting that they stop contacting you by phone at your residence and employer (if applicable). The letter MUST be sent certified & return receipt. The return receipt card is the proof that they got the letter (keep a copy of the letter with the green return receipt card for your records). If you just tell them on the phone, the request is only good for 3 days (if they even honor that - some disregard verbal requests altogether).

Below is a sample letter that you can use to send to the creditor. Be warned - once you cut them off from contacting you via phone, they may forward your account to the legal department to use other means of collecting the debt (file suit in order to obtain a judgement). So it is in your best interests to try to settle the debt with them. If you owe them - send them some money. This will prove that you are attempting to pay the debt. If you don't they will have the ammo to try to file suit.

If they disregard this letter (once you get your return receipt from the post office) - find a lawyer. But this letter should do the trick.

file a harassment suit as long as you have the documentation and tryed to clear it up then its on them ask them for a fax number send them a copy of your proof then have a witnes with you when you ask them not to call and harass you any longer document the calls when etc...can a call manager on your phone as well ,but you need to get this off you credit so you may have to go to court

tell them he does not stay there and to end calling. any better touch would be skipped over. eliminate my quantity from the touch checklist. permit your brother understand this and to end using you handle. you may to run credit comments to verify you're actually not listed on his debt! (this befell to me) confirm to under no circumstances co-sign something with him as he does not pay his charges! All mail could be decrease back by technique of writing "return TO SENDER - ADDRESSEE no longer AT THIS handle" in great marker. replace: To get your brother to end doing this and face his household projects, you are able to tell the callers his artwork quantity in case you already are conscious of it.
