If you have solid proof that the Officer is lying about an incident (traffic, crime, or whatever incident) can you dismiss the testimony or police report of that Officer in court?

I 100% agree with this statement "Any cop who knowingly lies shouldn't wear a badge, I do agree with that completely."

The judge can find the testimony not relevant to the matter. How this occurred is beyond me, I always testified truthfully in reports and in court. In fact, I lost a couple of cases due to my being totally truthful. It helped in the long run though because several judges said that if nothing else, I was honest in court whether or not it helped or hurt my case.

there is no such thing as dismissing a cops testimony, but you can re butt his testimony if you have the proper evidence, since most cops will and do lie , you had better have your evidence , alibi , witnesses or what ever in order, as judges want your money and will take the side of the cop in almost ever case, any one who don't believe it should sit in a court room some time and listen as most are not even good at lying, also don't forget the 47 men in Illinois who were sentenced to death and after a federal investigation proved that 35 of these men were not guilty, the prosecutor had lied , had the cops lie,and in some cases knew the men were not guilty, yet no charges ere ever filed against the prosecutor or any cop, the prosecutors reward for being a liar, he is now Attorney General for the state of Ill, same thing I n Los Angles
so you people who sit on a jury and think a prosecutor doesn't have an agenda is loco,

On our department you were automatically fired and lost your certification to enforce law if you were ever caught lying in court. If there was even a question you were put to the polygraph right away. I never once saw anyone lie in court.

The department wont keep a cop who lies in court because word will get out to every defense attorney who will use that to get charges dismissed. Once a cop gets caught one time they are ruined. Cops have families to support too. Do you really think that they would risk everything just to give you a speeding ticket or even charge you with something else? It can happen, it still does, but it is rare.

If an officer is untruthful in court and that can be proved the judge will dismiss that testimony and any other statements by the officer will be questioned.

That means all his previous testimony will be subject to review.

You can challege his testimony and police report with your evidence. The judge (or jury) then will decide which side best proved their evidence and they will win that trial. Make sure your evidence is extremely strong and well represented because the police officer has an advantage over you because he works for state law enforcement and you are a civilian.

you can produce evidence to prove his testomony wrong, or you can testify to what you beleived happen.

but you can not get his testomony thrown out without some proof he is lying.
