I did my federal and got the money for that but ran out of time to do my state. How do I go about submitting them so I can get the money. Will I owe because they are late?

As long as it is a refund due, there should be no penalty for being late. If you owed, there would be a penalty. The good news is that you have until May 1 to file 2006 VA Tax. VA also has an automatic 6 month extension option. There is no late filing penalty in VA if you do not owe.

You should file your 2005 VA return ASAP.

Although the Federal government does not assess a penalty for late filing if there is a refund due, some states DO assess late filing penalties even when a refund is due. OH is a good example of one that does; they assess a flat $500 penalty for late filing even if a refund is due. I don't recall if VA assesses such a penalty but you shouldn't delay in putting things right.
