i was still married and my wife wouldnt tell me how she filed (we were seperated) so i did the stupid thing and not file at all. i now want to fix my mess and pay my penalty. what do i do to fix this problem? any help will be greatly appreciated!

Go ahead and file a 2005 return. You'll have to file on paper, since you can't e-file for previous years. It will be a filed separately from your 2006 return, and be sure to use the 2005 forms and instructions.

The IRS will calculate the penalty that's due, and send you a bill for it.

You don't need your wife to tell you how she filed. If you did not sign her return she did not file jointly with you. So you are left with Married, Filing Separately or (possibly but unlikely) Head of Household.

Otherwise, Judy gave a comprehensive answer. Don't stress out too much over this. Yes, it will cost you more than it would have done if you'd filed, but the IRS are not ogres. If your previous record is unblemished they will take any tax, interest and penalties at most. You might even get the penalty abated.

go ahead and file for this time and when it ask you just write divorce and let them contact you if they want. letting it go again could be costly. right now you have a good excuse for not filing. Right?

You need to file a paper return, File Married Filing Separate to be safe.
