I live in an apartment building that is smoke free but I'm always smelling it through my air ducts. There are signs that say not to smoke in hallways and staircases but people don't always comply. However, when I went to talk to management they said there's nothing I can do about it as tenants are allowed to smoke in their own apts. which is what they do. So if I happen to smell it or they leave their doors open allowing smoke to enter the hallway it's well within their rights. Plus the maintenance people who work in our building tend to smoke too & there happens to be a maintenance room right next door to me. I kind of agree with the rights of smokers but unfortunately my non-smoking doesn't affect their air/breathing as much as their smoking affects mine. Plus, I have a certain sensitivity to it having already been diagnosed with emphysema & bad lungs despite not being a smoker. I need to know what to do as my building will not regulate it.

Rent a house. It's the only option you have to really be free of the smoke others leave behind. You onw home and your yard can be designated as smoke free and you, as the tenant can then enforce that rule.

You could contact the health department, but then that would cause undue friction with your neighbors and the management of the complex. Since you have already made your view known to them, they would know who complained. Nobody needs that kind of frictiion in their lives.

I'm sorry but you have to get over it. They pay rent too and should be allowed to smoke in their own home.
Get air freshners or a air purifier.
Smokers have almost no rights, yeah i believe second hand smoke is equally bad, but smoking is not illegal and their in their own homes.
let's say you were alcoholic and suffering from bad liver, u can't make others stop drinking in front of you, can you?
Too many non smokers are little babies. I don't smoke but my whole family does, out of respect they go outside of the house to smoke but if i still smell it on their clothes i deal with it because at least they attempt to smoke away from me, what little i smell i can get over.

Run a fan, and/or open a window or two.

Consider moving into a building that clearly states it enforces a no smoking policy in people's personal apartments.

A smoke-free building where people are allowed to smoke in their apartments? If no one is breaking the rules, you have no recourse. Move.

If the rental agreement states that they CAN smoke in their apartments, you have no recourse... other than pointing out the adjoining airducts.

Move on.

that sucks. i burn candles supposedly it grabs the smoke. get scented ones of course so you dont smell the stale odor of cigs.

go somehwere else. Now you see how it feels when you have to leave somewhere you are(and don't want to). Just like every smoker in the US does when they want to smoke.
