1. I was rear ended by some chick in a BMW, I have a 95 Crown Vic in poor (Cosmectic) condition, but it drives fine. She skuffed up my bumber and put a crack in the light. I went to get an estimate (Because she wanted to pay out of pocket because she is a Multimillion dollar producer realestate agent) I said fine, the damages came up to 900 dollars. then her husband said for her to go through her insurance. Problem is my car has a salvage title... ( I dont know what difference what makes...)

Now... I dont want my car fixed, it is not worth fixing, are they going to give me a check?


2. I went to the hospital the night after the accident with neck and head injuries but it is all muscle related so i have two perscription and im basically drugged up til the pain goes away... are they going to pay me for that too? Am I going to receive a check for pain and suffering or something?

.... She has Progressive Insurance, and I dont have insurance... how does that work??

Okay first... SHE HIT ME lol... I am only driving to wok and home until I can get my insurance next month, and Obviously I think of others, I stopped my car... she is the one that didnt.

In My state Insurance isnt required.

mamatohaley... Are you serious? LOL... I live in NH, and No... You do not have to have insurance in this state. So Do some research before talking.... crap.... As for yout FYI? that life isbnt just about me? Are you special? She hit me... therefore I can drive, she cant.

I am not retarded, things happen and it isnt totally smart driving without insurance, but as you can see here, SHE IS AT FAULT, Her Dumb A $ $ hit me.... Therefore it is good that she has insurance.

If the value of your car is less then $900, they will not pay you to repair it.

A salvage title means that at some point in time, that car was totaled. It was sold for salvage. To get it retitled after it's salvaged, someone got it running again and got it inspected and sold it to you. Chances are, the total value of a 1995 Crown Victoria that was previously totaled and is in poor cosmetic condition is not going to be worth a whole lot more than $900, if that. In excellent condition, which means it looks like new, it's only worth around $3500 so a salvaged car in poor condition is going to get maybe $700 - $800.

Gather your medical bills together along with your estimate and call Progressive. Give them copies of your bills and the estimate. They'll have you sign a medical release so they can get copies of your medical records for the injury. Yes, you have to sign the release if you want the bills paid. They have a right to see the records if you expect them to pay the bills.

Once you have all of that done, they'll make you an offer to settle the entire claim, car, medical and whatever they feel is justified for pain and suffering. You can accept that offer or if you don't feel it is fair, ask for more.

If you hire an attorney now, as several people have suggested, he will take one third of any settlement you receive. At this point, since you haven't even talked to them yet and you don't know what they will offer, I wouldn't go giving away a third yet.

Don't expect to get full price for your car though. Their obligation is to return you to the position you were before and the car just wasn't worth what the damages on it are.

I don't know about the auto portion but the medical depends on the state. In some states you have to qualify or "breach the threshold" before you can make a claim to have medical and pain and suffering reimbursed. You may be out of luck on medical since you were uninsured. If you had insurance you would have gone through your auto carrier.

With regards to your comment about it not being illegal to go without insurance in your state, you are mistaken. It is against the law in all states not to have insurance. You may not have a state that will keep you from collecting from the other person since you were uninsured but if you get caught without insurance you will lose your license.

I am a little confused about the mentality that it is okay for you to drive without insurance because you can't afford it. You would be fired up if the person that hit you was uninsured and you had to pay for all of this out of pocket! What if you get in a serious accident and kill someone? They will go after everything you own. Insurance also protects you. What if you were hit by another uninsured motorist and break your hip. The other person was an illegal immigrant and disapears. You have 50k in wage and medical loss. Oops, you didn't have insurance so no uninsured motorist claim for you. The bills are all yours.

Interestingly enough you have a working computer with Internet and if I was a betting woman your cell phone is still in service!! FYI - life isn't all about you!!

First of all, you need to get insurance. Stop playing with fire...you'll regret it. I would NEVER agree to take cash for an accident that was someone else's fault, because there's no paper trail to protect you in the event that you sustain bodily harm, as you have in this case. Why did you wait a whole day to go to the hospital? That's a question you may need to answer when the time comes. Keep all of your receipts/bills from any medical care that you need, as you'll have to work with her insurance adjuster in recouping those expenses. In the end, Progressive should cut you a check for the repairs to your vehicle, and you can do whatever you want with it. As for the medical expenses, you may want to contact an injury lawyer to make sure that all your bases are covered.

is it legal in your state to NOT have insurance? call a lawyer. most of them give free consultations. they'll know what's going on.
