Depends, in this shot, http://www.shootermovie.com/ he is definitely holding a variation of the Remington 700 series.
In the film trailer he is shown purchasing a rifle on which the box says ".300 WIN MAG" .
Since the M40 version of the 700 is a short action this would mean it is more along the lines of the M24 variant.

But in this shot, http://en.wikipedia.org/wiki/Image:Shooter_poster.jpg
the rifle is FAR more modified and difficult to identify, although the large detachable magazine most likely rules out a 700 series. This same rifle is in the official trailer at the web site. I have seen it before but needed to look it up to find remember the name. It is the Intervention M200, made by CheyTac, chambered in .408 CheyTac, one mean round.

Based on looking at the safety switch and the bolt handle, it is a Remington 700 action. As for the stock, barrel, and scope, you can't see them and it's probably a custom rifle anyways. The character is supposed to be an ex-marine so it is probably some variant of an M40 but it could also be anything.
