Why can people sell picture of celebrites without a signed release, but cannot sell pictures of a "regular" person without a release?

Celebrities, politicians, etc. are categorized as "public figures" and have less privacy rights than regular people. Because of their positions, the courts have ruled that these people have to expect less privacy.

However, this only applies when they are out in public places. They still have the right to privacy when in their homes or other private property. Some have won lawsuits for pics taken when at home.

Technically you can take pics of anybody or anything out in public for your personal use. However, you cannot sell or otherwise publish pics of regular people without permission.

However, many people feel strongly that they should not be photographed without permission. It's always best to ask first to avoid unpleasant situations. And get a release if you intend to publish.

People seem to be able to do that other regular people but gee wiz, if you get a celebrity you're in for it. I think it's mostly because if you sell the pictures people will already see them and when a new tabloid magazine comes out no ones interested in what they say Jessica Simpson did, they've already seen the picture. But regular can take a picture of some normal person and that's ok! Everyone cares about celebrities and how the media gets to portray them but no one cares about the well being of people who live in the real world not the ones actors portray on t.v.!

i dont know the exact law, but a public figure has agreed to put them self in the public light.

from what i found, you cant take a picture of a celebrity and use it for an advertisement, but you can sell a photo if it is news worthy. The same could be said for non-celebrities, so long as the photo is NEWS WORTHY.

Its is under news worthy, that people take all of those crazy shots of celebrities and sell them to tabloids, they can take, sell and publish them under the guise of NEWS WORTH.

Is some movie star kissing someone "news worthy"? thats another question.
