First, the proper term for this device is SUPPRESSOR, NOT 'silencer', a term perpetuated by mobsters, gangstas, the uninforrmed masses, and the uneducated idiots in Hollywierd!
No firearm is 'silent' with any device.
Contrary to the ignorant belief, suppressors are LEGAL for possesion AND USE in the United States, and can be purchased by ANY Law-abiding citizen. It is done under the Federal law BATFE regulations governing the sale of Class 3 destructive devices, including full-auto machine guns, suppressed firearms, and, believe it or not, even CANNONS.
I know this for a fact, as I have several friends who are legal owners of automatic weapons and suppressed firearms.
Any Class 3 dealer can provide you with paperwork and info on purchase and transfer of LEGAL suppressors.
To begin the procedure, I would contact the local office of the BATFE, if one is nearby, or the closest FBI office, as they will probably be running the background checks.

Silencers are legal in 36 states of the union including Indiana. Your best bet is to contact a dealer licensed to sell suppressors in your state. Take a look at the links below for advice on good dealers to go to in your state. The process is usually simple; pay for the silencer, the dealer gives you an ATF form 4 to bring to your local sheriff for his/her signature, dealer sends the form the BATFE along with fingerprint cards, photos, and a $200 check. The sheriff’s signature is sometimes the only hard part; some of them do not want to sign. From what I have read on www.subguns.com the wait is about 1-3 months for approval now.

Another option is to make your own. If you are handy with a metal lathe, then it is not hard to make a good silencer. Just use the ATF form 1. It requires the same photos, tax and sheriff’s signature as the form 4. I make my own suppressors using ATF form 1’s

There is no federal law requiring a civilian to have any permit or license to own, buy, sell or make a suppressor. All that is required is to have the required tax stamp as proof of legal ownership. Dealers, importers and manufacturers are required to be a class 1, 2, or 3 FFL/SOT to have any title II weapons (machineguns, short barreled rifles/shotguns, silencers) as their business.

It is amazing how many idiots post here and that say silencers are illegal in the USA. They have never read any federal law making them illegal, but for some crazy reason they are so stupid that they do not even try to read the law before making fools of themselves on this website.

Check with BATF in your State. Don't risk being arrested on a Federal firearms violation because of hearsay advise. Being able to purchase & have one at home is different from being stopped by the police on a different violation then found to be in possession of a suppressor, suppressed firearm or fully automatic weapon. 911 changed a lot of things.

To buy a silencer in the United States, you must live in a state that allows Class 3 weapons, and you must meet every handgun purchase qualification as well as recieve a signature from your local chief law enforcement officer stating that you have no pending felony cases against you and that you are mentally stable, you must submit fingerprint card with two passport photos, and you must pay a NFA tax of $200.

Your state may have more requirements in addition to this. States that DO NOT allow silencers are California, Delaware, Washington DC, Hawaii, Illinois, Iowa, Kansas, Mass., Michigan, Mississippi, Missouri, New Jersey, New York, Rhode Island, and Vermont.

View the link below for more detailed information on requirements each state force you to meet.

Legal or Illegal? Assuming you aren't a felon, start at the local library in your area. Go to the Law section. After verifying that it's ok to obtain one in your state, go to the state offices to obtain all the required forms. Bring LOTS of pens as you'll be needing them. See, they want you to realize that you really don't NEED a silencer and they're going to make you do all kinds of paperwork if you really, really, really want one. After State Police, B.C.I., F.B.I., and A.T.F approval, paying bukoo fees, getting finger-printed they're going to want to know where you're getting it! It's not like silencers are in the showcase at the corner gun shop. It must come from a registered manufacturer. I don't know Indiana laws nor am I going to look them up. You might as well get used to not getting much help with this. You won't get much. BTW, ppl that think or say that silencers or other "illegal" weapons aren't obtainable really need to educate themselves before they let their mouths open.

First, its illegal to have or use one so the only way to get one would be the black market. And second, why would you need one? To pretend that you are James Bond? To pretend to be a cop? To kill someone without anyone hearing you? The point is is that you don't need one and you can't get one legally. So I would drop it before you find yourself a life sentince in the big house.
