my boyfriend and I have been together for 2 years, and recently he told me that he was illegal. He came to this country legally, but his parents didn't take care of his paperwork right away and now he's illegal. He's been in America since he was six years old, and his mom and his sister are citizens, but they became citizens after he turned 21 and they couldn't fix it for him. He hasn't asked me to yet, but I wanted to find a way to help him. He doesn't drive, before he used to make excuses like he was on some sort of probation or something, and now when i finally confronted him about it, he told me. I've learned that if we get married, it can help him get legalized, but I don't know how to go about it, can somebody help me?

this is a tough one. i know how you feel my fiance and i are trying to get the visa to get married, he is here now but only has another month before he is deported. there are a couple ways to go about this, first if he has been here since 1972 then he is fine, but i think that he is probably younger than that. two, you can apply for a fiance visa but there is no way to be sure you will get it, and if he has been here for this long then he has nothing established in his country of citizenship. three, he is older than 21 so it may be harder, but, he should apply for a family visa since his mother is a citizen. that is probably going to be the best route to go. immigration is TOUGH now, i know it sux completely, so he will have to go to his native country at least to fill out paper work for wich ever route you chose to take. he will probably be required to leave for at least a little while. I would definately start working now to get everything processed, it takes a long time. start researching the different ways to get a visa. i hope they are easy on him since he really is an american since he has been here so long. check out www. uscis.gov, you can file there or at the closest service center to you. you can look up all the immigration centers in your states directory. most big states have a couple centers, if you are in a small state then its most likely in the capital. dont rush into marriage because its just as hard to get a fiance visa or a spouse visa as anything else. im so sorry you are in this situation, i know its hard. just do the research at that website and if its too much just hire an immigration lawyer, i wish i would have in the beginning. otherwise you may be waiting months for a visa that they deny because of some stupid reason in the fine print. so if you have the money just hire one. i hope i could help a little and i hope everything works out.

If you are a US citizen, you can help him become legal by marriage. The process is not easy, it costs a lot of money and time. Besides you may need a lawyer which is going to increase the total cost. Marry someone that you love very much. Do not marry just to help a person get papers.
USCIS follows rigorous rules, if you marry him you two will go to an interview, there you have to present proof that you and your husband marry for love and in good faith. If some reason they suspect a fraud marriage you and him will get in trouble.
Think about it. Good luck.

Marrying an immigrant does not make them an instant citizen. You will need to check the US Government website for your options. I would suggest that he get in touch with an organization that assists people (gives them the correct information and direction) with immigration. Please do not count on getting the correct information from people here on Yahoo Answers. Although there are some well meaning people, it's best that your boyfriend get in touch with the correct people.
Also, there is a Child Citizenship Act of 2000. I'm not sure if it would apply but it will help that his mother is now a citizen.

Good luck.

If you are accurately explaining his story it sounds REALLY fishy. He has to be LEGAL BEFORE any paperwork is started. Being married can HELP but he still has to apply and he can't apply if he is an illegal alien.
Again, HIS STORY SOUND LIKE HE'S LIEING TO YOU! If you have been together for two years and he just told you, that sound fishy also. Sorry but I think he's using you.

The only way for him to legalize his status is to marry a US citizen (you). Since he came to the USA lawfully on a visa, but overstayed -- he should be able to get a green card IF marries a US citizen.
If you need more help, you are welcome to email me directly.

I think California does not allow GAY marriage. You will need to move to Boston.
