I am sorry to tell you this but you are in for a very tough time. Shoplifting and possession. Wow! You might get a lesser sentence if the judge is a good guy but be prepared for the book being thrown at you. They will know if you are a user and if you are they have you on the drug charge. Of course, they could blame you for being a pusher but there is no real proof so this will not stick. Just hope for an understanding judge.

How do you explan them being in your possession?
They stumbled upon them legally, as you were shoplifting right?
If you were not shoplifting, and they pulled you aside and searched your bags, then found that, thats something you could argue andpretty much beat.
But the fact that you wewre guilty of the crime that led to the search, makes it perfectly okay for them to begin investigating the substance.
And since you had it in your possession, its going to take a magical arguement to beat the odds that you are responsible for what you had in your possession.
I dont think our legal system is as dumb as you want it to be.
Youre going to go to trail, and if you do use meth, or have used meth, you could be held for pergury if they link the bag to you when you claim it wasnt yours.
Be aware of that.
thats a serious offense right there.
The sad thing is that Libby whos on trial for perjury among other things, as well as weakening this countrys intelligence system will probably not see a day in jail, where you probably are.
FYI -- In any store, legally they can only stop you if they witnessed you trying to exit the store with their goods.
Even if the alarm goes off, they cant stop you -- or I should say you dont have to stop.
If youre guilty youre guilty thats one thing.
But Best buy and walmart pulling you to the side and askign to look into your bags, is all voluntary. they cannot force you to do that, and they cant dtain you if you dont do it -- IF YOU DIDNT TAKE ANYTHING THAT IS.
And even though some might argue -- they cant stop you even if the buzzard goes off -- UNLESS THEY SEE YOU SHOPLIFTING.
Its your personal bags once you pay for them, and even police need probably cause to search your personal belongings.
So next time that store buzzard goes off, or they want you to wait in line as you exit the store just to search your bag, or compare reciept..feel free to keep walking -- SO LONG AS YOU DONT HAVE ANYTHING on your purson that you didnt pay for.
Call the cops -- verify it.

Oh my gosh! I was carrying drugs and I had no ******* idea!! The cops have never heard that before!!
Seriously: you need a lawyer. Get a lawyer, tell them your story and let them do the rest of the story telling. If you're lucky and it's your first offense, you may get off with probation. Then, lose the habit. If you're not, and this is another offense, you may get rehab/jail time and some probation. And, lose the habit.

They found illegal substances in your possession. No matter if you knew they were there or not, they were in YOUR belongings. You will have a hard time trying to prove otherwise.
I work as a Loss Prevention officer for a very large retail store, you are a dumb *** for stealing. I hope you get what they charge you with.

My cousin is a California deputy sherrif and he says that almost all people busted for possession act like they have no idea how they came into possession of whatever it is they were busted for.
Do yourself a favor and plead. If it's your first offense then they should cut you a little slack.
