Probably, another stupid law in a an increasingly safety stupid country.

In Ontario it is illegal if they are already quite drunk. A bar can be charged for not "cutting off" a patron from further drinking.
The bar AND a person having a party at their place are also expected to take the drunk person's car keys so that they either take public transportation or a taxi home.
It is not uncommon for waitresses to ask "So how are you getting home tonight?" They even have free coffee for the designated driver in many bars that believe in the "Drink Smart" Program.
My advice use your discretion....If you were this person's wife or husband would you want them to have another drink?

The only way you can get into trouble for asking a guest if they would like another drink is if they are underage, or if they are drunk. As a server you could be held liable if you over served a guest and they go out and get into an accident, but it varies upon state/country law.

In some states such as Massachusetts the bar and the server are liable if the person gets injured while drunk driving. So if you encourage that person to drink beyond the limit you could be held legally responsible for any damages.

That sounds like something that would be a state or local law, rather than a federal one. You should check with your state's liquor commission for more information.

It is possible to be prosecuted if you continue to serve an obviously drunk individual, and if they get in an accident or kill someone whild driving after you've continued to serve them, you may be held legally accountable to some degree.

Just be careful.

Depends on if your in a restaurant or in a bar.
In a restaurant you would ask if they would like anything else.
In a bar is usually, self explanatory (your in a bar what else would you want).
If you've had enough anywhere, usually the waitress will not be coming back to ask if you need another one.
