I've seen a lot of people CLAIM the law requires them to accept partial payments and that they can't sue if you make regular payments. I have NOT seen anyone cite the actual law. My guess is that no such law exists. That said, I've never heard of anyone that you owe money actually returning a check. I've also never heard of any collection agency telling you they would sue and actually following though on the threat. If they are going to sue, they will file suit and you will find out when you receive the paperwork showing the suit has already been filed.

The same reason they come after me, if its at a collection agency what they did is probably bought the right to collect on your bill from the dr or hospital you went to. If you could not or would not make payments with the hospital or doctor, they can not trust you to make payments w/ them. If they win in court (and they always do) they can put a garnishment on your wages. Your best bet is to let them file but be sure to respond to the Suit after you are served. Punitive damages and legal fees thrown in if you ignore it will be twice what you actually owe!!
