will the irs penalize them or me? can i file my other W-2 forms without that one?

You don't have to have the original W2 to file. Instead, you can file a Substitute W-2 (IRS Form 4852). Just fill it out and attach it to your return. Use the info from the form with the wrong SSN or from your last paystub. I have the link to print the form below.

Employers are requred to provide you with a proper W-2 by Jan 31. A W-2 with the wrong SSN is not a proper W-2. If they refuse to correct the error, contact the IRS. Employers can be penalized for failing to provide W-2s on time.

You need all Forms W-2 to file a valid return.

i like your question and bravo that you caught that error on your w2 form ...first thing you need to do is contact the irs and tell them that your ssn is wrong and the employer is draging their feet in fixing it and also check with the socail securty office and make sure that has not been a problem all year long..and becouse it is late in the tax season you will need to go ahead and fill out your income tax forms and mail them in after you contact the irs and explain the problem..

This got here about to me in 2003. call the IRS and clarify your project. they are going to likely have you ever document a criticism hostile for your employer. Then they are going to ask once you've any paystubs and genuinely you are able to estimate your income. The criticism is only to hide your *** in case something shady is going down. I filed my expected income and all has been reliable.

Demand it in writing and get a receipt for delivery of the letter from the post office.
