I'm assuming you are talking about the Visa gift card....if so, whoever signed the back of the card is the person is the person who should be using it. If your mom signed it, I guess you could still go and use it because when they run the card, they are going to ask for you to sign the receipt and they most likely won't even look at the signatures to compare. If they do, you explain that your mom purchased the card for you, but she signed it. You could maybe even ask your mom to write a note that you could take with you to stores to prove that she signed it.
In general, you shouldn't use a credit card that doesn't have your name on it, but I highly doubt you could get in legal trouble in you use it.

If it has her name on it, you may not be able to use it at some stores as they'll ask you for ID. You would be able to use it at a gas station because they never check.
As long as your Mom has given you permission to use it, no, you won't be punished. It is illegal to use a stolen card. However, in this case, you didn't steal it. Your Mom gave it to you.
I'll warn you though, a lot of stores are not going to accept it with someone elses name on it.

those visa cards are widely accepted in online stores. consider using those instead as more often than not they do not require ID
